According to the Regulation, a Responsible Person, being a legal or natural person established in the European Union, should be established for each product placed on the market. A Responsible Person may be a manufacturer, distributor or importer or an entity designated by them.
In the case of a cosmetic product produced in the Community, the Responsible Person is the manufacturer established within the Community. The manufacturer may designate, by written mandate, a person established within the Community as the Responsible Person.
If a manufacturer of a cosmetic product produced in the Community and not subsequently exported and imported into the Community is established outside the territory of the Community, he appoints a Responsible Person established within the Community as the Responsible Person.
In the case of an imported cosmetic product, the Responsible Person for the exact cosmetic product that he places on the market is every importer. The importer may appoint a responsible person as the Responsible Person in the European Union.
The distributor is the Responsible Person if it introduces a cosmetic product to the market under its own name or trademark or changes a product already placed on the market in a way that may affect compliance with applicable requirements.
